Hyundai Oilbank and the Ministry of Environment are showing a sharp battle over the imposition of the largest penalty ever.
Hyundai Oilbank was fined 150.9 billion won by the Ministry of Environment, the largest ever. The reason is that Hyundai Oilbank discharged wastewater containing phenol, a harmful substance, illegally. The detected amount of phenol has exceeded the limit.
Based on this, the Ministry of Environment imposed a fine of 150 billion won on Hyundai Oilbank for discharging wastewater under the Water Environment Conservation Act(WECA) in October last year.
From October 2019 to December 2021, Hyundai Oilbank sent 950 tons of wastewater per day from Daesan Plant in Seosan, South Chungcheong Province to Hyundai OCI Plant. Hyundai OCI recycled it as industrial water. The Ministry of Environment judged that Hyundai Oilbank violated WECA, saying that it discharged water pollutants without going through a wastewater disposal facility.
Hyundai Oilbank said, "In response to chronic water shortage, wastewater was recycled as industrial water and then discharged according to legal standards, so there was no environmental pollution or human or material damage" and "It contributes to resource-saving and the environmental system”
On the other hand, the Ministry of Environment said, “When Hyundai Oilbank supplied wastewater to Hyundai OCI, Hyundai Oilbank was unable to remove impurities because they did not install wastewater disposal facilities in the pipes”

현대오일뱅크와 환경부가 역대 최대 과징금 처분을 놓고 첨예한 갈등 양상을 보이고 있다.
현대오일뱅크가 환경부로부터 역대 최대 금액인 1509억원의 과징금 처분을 받았다. 유해물질인 페놀이 기준치 이상으로 검출된 폐수를 무단으로 배출했다는 것이 그 이유다.
환경부는 이를 근거로 지난해 10월 물환경보전법상 폐수를 배출한 현대오일뱅크에 1500억 원대의 과징금을 부과했다.
현대오일뱅크는 2019년 10월부터 2021년 12월까지 충남 서산 대산공장에서 나오는 하루 950톤의 폐수를 현대OCI 공장으로 보냈다. 현대OCI는 이를 공업용수로 재활용했다. 환경부는 "현대오일뱅크가 수질오염 물질을 폐수처리장을 거치지 않고 배출했다"며 "물환경보전법을 위반한 것으로 판단했다"고 밝혔다.
현대오일뱅크 측은 "만성적 물 부족에 대응해 폐수를 공업용수로 재활용 한 후 적법한 기준에 따라 방류해 환경오염이나 인적·물적 피해가 발생하지 않았다"면서 "(이런 방안은) 물 사용량과 폐수 발생량을 줄여 자원절약과 환경보호에 기여했다"라고 주장했다.
반면 환경부는 "현대오일뱅크가 현대OCI로 폐수를 보낼 때 배관에 폐수방지시설을 설치하지 않았기 때문에 불순물을 제거할 수 없었고, 폐수방지시설 설치 의무를 면제받는 과정에서도 현대오일뱅크가 서류를 허위로 작성하는 등 불법이 있었다"고 설명했다.
양측의 주장이 보는 관점에 따라 위법과 적정성이 엇갈리는 가운데 이번 과징금 부과가 적법한가에 대한 현대오일뱅크와 환경부의 첨예한 법정 공방이 예상된다
